Returns, Exchanges and Refunds
This page is a concise and accessible summary of Section 6 of the ENTUZIAST Online Store Public Offer Agreement.
1. GOODS OF PROPER QUALITY
Alcoholic beverages of proper quality cannot be exchanged or returned.
Alcoholic beverages are beverages intended for human consumption and therefore constitute food products. Food products of proper quality are included in the list of goods that cannot be exchanged or returned.
If an alcoholic beverage corresponds to the order, is of proper quality and has no defects, it cannot be returned or exchanged for reasons unrelated to its quality. This rule is established by Ukrainian law and is not a separate restriction introduced by the Online Store.
2. GOODS OF IMPROPER QUALITY
The restriction applicable to goods of proper quality does not deprive the Buyer of their rights if they purchase an unfit food product.
Under Part 8 of Article 8 of the Law of Ukraine “On Consumer Rights Protection” No. 1023-XII, if a consumer purchases an unfit food product, the Seller must replace it with a food product that is fit for consumption or refund the amount paid for that product.
3. GOODS THAT DO NOT CORRESPOND TO THE ORDER
If the received product does not correspond to the order, the Buyer may contact the Seller. The claim will be reviewed according to the actual circumstances and the requirements of applicable Ukrainian law.
4. REPLACEMENT OR REFUND
If the improper quality of the product is confirmed, the Buyer may request:
- replacement with a product of proper quality; or
- a refund of the amount paid for the product in accordance with applicable Ukrainian law.
A refund is processed in accordance with applicable law and the procedure corresponding to the payment method used for the order.
The Seller refunds the payment to the Buyer on the day the Agreement is terminated. If the payment cannot be refunded that day, the Seller agrees a refund date with the Buyer — no later than 7 calendar days from the date the Agreement is terminated.
5. HOW TO CONTACT THE SELLER AND WHO PAYS THE COSTS
To request a return, replacement or refund, the Buyer may contact the Seller:

The return or replacement of a product whose improper quality has been confirmed is carried out at the Seller’s expense.
6. LEGAL BASIS
The terms on this page are based on the following applicable laws of Ukraine:
- Law of Ukraine “On Consumer Rights Protection” No. 1023-XII, in particular Part 8 of Article 8;
- Resolution No. 172 of the Cabinet of Ministers of Ukraine dated 19 March 1994 and the List of goods of proper quality that cannot be exchanged or returned approved by it;
- Law of Ukraine “On the Basic Principles and Requirements for Food Safety and Quality” No. 771/97-VR, under which food products include beverages.
